Terms and Conditions

These terms and conditions (“Terms and Conditions”) govern the purchase, sale, and use of gift cards and gift certificates (“Gift Cards”) issued by Native Growers Nursery.(“Native Growers Nursery,” “we,” “us,” or “our”). Gift Cards must be redeemed through our website nativegrowersnursery.com (“Website”) Purchases made using Gift Cards are subject to our Website Terms of Use (nativegrowersnursery.com) in addition to these Terms and Conditions, and such Website Terms of Use are incorporated herein and made a part of these Terms and Conditions by reference. Native Growers Nursery reserves the right to update and/or change these Terms and Conditions at any time without notice. Use of a Gift Card constitutes your acceptance of these Terms and Conditions.

The funds on Gift Cards issued by Native Growers Nursery does not expire, and dormancy fees do not apply. You may contact Native Growers Nursery at contact@nativegrowersnursery.com for any questions.

Information regarding the balance of your Gift Card is available by emailing us at contact@nativegrowersnursery.com. The balance you receive when inquiring is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed. 

Gift Cards are not redeemable for cash and cannot be returned for a cash refund, unless required by law. Except as otherwise provided, any unused balance will remain on the Gift Card and is non-transferable. Gift Cards are not reloadable, and are not for resale. Gift Cards may not be used to purchase other Gift Cards. Native Growers Nursery does not permit returns and exchanges of merchandise purchased using a Gift Card. Note that gift cards get sent to the payers email address.

Native Growers Nursery is not responsible for lost, stolen, damaged, or destroyed Gift Cards, or use of a Gift Card without your permission, and Native Growers Nursery will not issue a replacement Gift Card in these circumstances. Native Growers Nursery reserves the right to correct a Gift Card balance if we believe that a clerical, billing, or accounting error has occurred. We further reserve the right to deactivate, cancel, or suspend any Gift Card if we suspect fraud, unlawful activity, or improper Gift Card use. The maximum value that can be associated with any one Gift Card is four hundred dollars ($400.00) and total purchases of Gift Cards by any one individual may not exceed four hundred dollars ($400.00) in one calendar day. All personal data collected during the sale and use of Gift Cards will be treated in accordance with our privacy policy.  

NATIVE GROWERS NURSERY AND OUR AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ITS GIFT CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

Please note that promotional cards or gifts offered by Native Growers Nursery, including, without limitation, promotional gift cards offered in connection with loyalty rewards programs or employee rewards programs, may be subject to an expiration date and separate terms and conditions.If any provision of these Terms and Conditions is determined to be invalid, illegal or unenforceable, the remaining provisions of these Terms and Conditions remain in full force to the extent permitted by law.These Terms and Conditions are governed by the laws of the State of Florida.
